Terms and Conditions for applying to the Trailblazer Program 2023 ("Terms")

By applying to the Trailblazer Program 2023, you accept these Terms. Please read these Terms carefully before applying. 

 

1. General Terms

 

Peak Performance is launching the Trailblazer Program 2023 (“Program”) which is aimed to sponsor initiatives that aim to close the gender gap in the outdoors. The Program provides an opportunity to apply for sponsorship up to a value of EUR 8000 to realize projects with an ambition to promote women taking actively part in the outdoor lifestyle. 

 

Among all eligible applications received during the Program Period as defined below, Peak Performance will choose up to 8 projects to sponsor and will execute sponsorship agreements with the chosen applicants. The sponsored projects shall be fulfilled within a year of the receipt of the sponsorship. 

 

These Terms govern the relationship between you ("you" or the "Applicant") and Peak Performance Production AB, a company incorporated in Sweden with the organization number 556277-6434 and with registered address at Frihamnen, Magasin 1, 115 41 Stockholm ("Sponsor") in relation to the Program. Questions and feedback about the Program may be brought to the attention of Sponsor through the aforementioned contact details.

 

The Program application period begins on March 8, 2023 at 9:00 CET and ends on May 8, 2023 at 21:00 CET (inclusive) ("Program Period"). Only application received within the Program Period will be taken into account. The Sponsored Projects will be chosen by June 8, 2023 and will be communicated to the applicants by the same date. 

2. Eligibility and instructions to apply

The Program is open to applications from individuals who are legal residents of Sweden, Finland, Norway, Danmark, Germany, Austria and Switzerland who are over the age of majority in their jurisdiction of residence. The supported projects and initiatives shall take place in the same region. The Sponsor may require the chosen applicants to certify their eligibility to participate in the Program.

 

Employees, representatives and agents of the Sponsor or those of any of its affiliates and anyone otherwise connected to the Review Committee or with the operation or fulfillment of the Program, are not eligible to apply to the Program. No responsibility is accepted for late, lost, delayed, damaged, corrupted, illegible or incomplete applications, which shall be disqualified at the discretion of the Sponsor, or for transmission or computer error affecting the logging of applications. 

 

If you apply or attempt to apply to the Program in violation of these Terms, your project cannot be chosen to receive sponsorship.

 

In order to apply to the Program you will need to present your project plan which is aligned with the Program’s aim and specify the applied budget to realize your project (“Submitted Material”). You will also need to provide with all relevant contact information as informed in the application form. 

 

By applying to the Program, you warrant that you hold all rights necessary to the Submitted Material, that such material does not infringe the copyrights, trademarks, moral rights, rights of privacy/publicity, trade secrets, or any other intellectual property or personality or privacy rights of any person or entity and that no other party has any right, title, claim, or interest in or to the submitted material. 

 

If your project is selected as a Sponsored Project, you will further allow the Sponsor to use your name and use, reproduce, modify, adapt, publish and display your Submitted Material as well as biographical information, photographs, video recordings, statements, and other such materials provided by you in its advertising and marketing for a period of 5 years for advertising and marketing purposes without any further remuneration or separate agreements to the extent permitted by mandatory law. In doing so, the Sponsor will acknowledge you and/or your contribution to the extent required under applicable mandatory law.

Applications to the Program are not subject to a charge. 

 

 

 

3. Selection of Sponsored Projects

The Sponsor will choose up to 8 projects to support among all eligible applications received during the Program Period, each which will be supported with the requested value up to EUR 8.000 (“Sponsored Projects”). 

 

All eligible applications will be reviewed by the Review Committee consisting of Peak Performance team members as of the closing of the Program Period on 8th of May 2023. The review will be concluded by June 8, 2023 and the chosen Sponsored Projects will be communicated to the applicants via provided contact details by the same date.  

 

Once the Sponsored Projects have been chosen and communicated to the applicants, a sponsorship agreement shall be executed between the Sponsor and the applicants of the Sponsored Projects (“Sponsorship Agreement”).

 

 

4. The sponsorship value

Each chosen Sponsored Project will be sponsored with the requested sponsorship amount up to a value of EUR 8000 (“Sponsored Amount”). The Sponsored Amount can consist of a financial support as well as product support depending on the project and the request. The Sponsored Amount will be provided to the applicants without undue delay after executing the Sponsorship Agreement. 

 

The Sponsorship is personal, non-exchangeable, non-transferable and non-refundable. To the extent not prohibited under applicable mandatory law, you will be solely responsible for all applicable taxes relating to your receipt and/or use of the Sponsored Amount, if applicable. The Sponsor will give notifications to tax authorities and pay any taxes that it is obliged to pay in accordance with applicable mandatory law. 

 

5. Liability

The Program is in no way sponsored, endorsed, and/or administered by, or associated with, Instagram and Facebook. You hereby agree to release, indemnify and hold harmless Instagram and Facebook from any liability in connection with the Program.

 

To the extent permitted by applicable mandatory law, by applying to the Program, you agree to release the Sponsor and its affiliates from any and all liability arising in any manner out of the Program including, without limitation, the selection of the Sponsored Projects, the administration of the Program, and the acceptance or the use of the Sponsored Amount or any component thereof as well as to indemnify and hold the Sponsor and  its affiliates harmless from and against any claims, damages, liabilities, losses, costs or expenses arising from, or attributable to, any of your acts or omissions relating to the Program. Except in the event of gross negligence or willful misconduct, the Sponsor's and/or its affiliates' liability will case be limited to the Sponsored Amount to the extent permitted by applicable mandatory law.

 

The Program aims to support projects with an ambition to promote women taking actively part in the outdoor lifestyle and closing the gender gap in the outdoors. Depending on the Sponsored Project, the completion of the Sponsored Project may entail being outdoors and participating in sports and activities which can involve an inherent risk for bodily injury or even death. By applying to this Program, the applicant of a Sponsored Project will agree to release the Sponsor from all liability, harm, damage, property loss, bodily injury or death related to the Sponsored Project, and acknowledge that the Sponsor’s only duty is to provide the agreed Sponsored Amount. It will be the applicant’s responsibility to ensure appropriate insurance for completing the Sponsored Project. Nothing in this section shall exclude or limit the Sponsor’s liability to the extent the same may not be excluded or limited by applicable mandatory law. 

 

6. Dispute Resolution

These Terms shall be governed by the laws of Sweden.

 

If you have a complaint relating to these Terms, we will attempt to resolve the complaint internally. Ultimately, any dispute shall be brought before the Court of first instance with jurisdiction over the place where you are a legal resident.

Allgemeine Geschäftsbedingungen für die Bewerbung auf das Trailblazer-Programm 2023 („Bedingungen“)

Durch Ihre Bewerbung für das Trailblazer-Programm 2023 akzeptieren Sie diese Bedingungen. Bitte lesen Sie diese Bedingungen sorgfältig durch, bevor Sie sich bewerben. 

 

1. Allgemeine Teilnahmebedingungen

Peak Performance startet das Trailblazer-Programm 2023 (das „Programm“), das Initiativen sponsern soll, die darauf abzielen, die Geschlechterlücke im Outdoor-Bereich zu schließen. Das Programm bietet die Möglichkeit, sich für ein Sponsoring im Wert von bis zu 8.000 EUR zu bewerben, um Projekte mit dem Ziel zu realisieren, Frauen zu fördern, die aktiv am Outdoor-Lifestyle teilnehmen. 

 

Unter allen teilnahmeberechtigten Bewerbungen, die während des unten definierten Programmzeitraums eingehen, wählt Peak Performance bis zu 8 Projekte für das Sponsoring aus und schließt mit den ausgewählten Bewerbern Sponsoringvereinbarungen ab. Die gesponserten Projekte sind innerhalb eines Jahres nach Erhalt des Sponsorings durchzuführen. 

 

Diese Bedingungen regeln die Beziehung zwischen Ihnen („Sie“ oder der „Bewerber“) und Peak Performance Production AB, einem in Schweden eingetragenen Unternehmen mit der Organisationsnummer 556277-6434 und eingetragenem Sitz in Frihamnen, Magasin 1, 115 41 Stockholm („Sponsor“) in Bezug auf das Programm. Fragen und Feedback zum Programm können dem Sponsor über die oben genannten Kontaktdaten zur Kenntnis gebracht werden.

 

Der Bewerbungszeitraum für das Programm beginnt am 8. März 2023 um 9:00 Uhr MEZ und endet am 8. Mai 2023 um 21:00 Uhr MEZ (einschließlich) („Programmzeitraum“). Es werden nur Bewerbungen berücksichtigt, die innerhalb des Programmzeitraums eingehen. Die gesponserten Projekte werden bis zum 8. Juni 2023 ausgewählt und den Bewerbern bis zum selben Datum mitgeteilt. 

 

2. Teilnahmeberechtigung und Anweisungen zur Bewerbung

Das Programm steht für Bewerbungen von Personen offen, die ihren rechtmäßigen Wohnsitz in Schweden, Finnland, Norwegen, Dänemark, Deutschland, Österreich und der Schweiz haben und in ihrem Wohnsitzland volljährig sind. Die unterstützten Projekte und Initiativen müssen in derselben Region stattfinden. Der Sponsor kann von den ausgewählten Bewerbern verlangen, ihre Berechtigung zur Teilnahme am Programm nachzuweisen.

 

Mitarbeiter, Vertreter und Beauftragte des Sponsors oder eines seiner verbundenen Unternehmen und Personen, die anderweitig mit dem Prüfungsausschuss oder mit dem Betrieb oder der Durchführung des Programms in Verbindung stehen, sind nicht berechtigt, sich für die Teilnahme am Programm zu bewerben. Es wird keine Verantwortung für verspätete, verlorene, verzögerte, beschädigte, technisch beschädigte, unleserliche oder unvollständige Bewerbungen übernommen und diese werden nach Ermessen des Sponsors disqualifiziert werden und ebenso wird keine Verantwortung für Übermittlungs- oder Computerfehler übernommen, die die Protokollierung von Bewerbungen beeinträchtigen. 

 

Wenn Sie sich unter Verstoß gegen diese Bedingungen bewerben oder versuchen, sich für das Programm zu bewerben, kann Ihr Projekt nicht zum Sponsoring ausgewählt werden.

 

Um sich für das Programm zu bewerben, müssen Sie Ihren Projektplan präsentieren, der mit dem Ziel des Programms im Einklang steht, und das angewandte Budget angeben, um Ihr Projekt zu realisieren („eingereichtes Material“). Sie müssen auch alle relevanten Kontaktinformationen angeben, wie im Bewerbungsformular erfragt. 

 

Durch die Bewerbung für das Programm gewährleisten Sie, dass Sie alle Rechte besitzen, die an dem eingereichten Material erforderlich sind, dass dieses Material nicht gegen Urheberrechte, Marken, nicht übertragbare Urheberrechte, Datenschutz-/Veröffentlichungsrechte, Geschäftsgeheimnisse oder sonstige Rechte des geistigen Eigentums oder Persönlichkeits- oder Datenschutzrechte einer natürlichen Person oder juristischen Einheit verstößt und dass keine andere Partei Rechte, Titel, Ansprüche oder Anteile an dem eingereichten Material hat. 

 

Wenn Ihr Projekt als gesponsertes Projekt ausgewählt wird, erlauben Sie dem Sponsor ferner, ohne weitere Vergütung oder separate Vereinbarungen, Ihren Namen zu verwenden und Ihr eingereichtes Material sowie biografische Informationen, Fotos, Videoaufzeichnungen, Aussagen und andere solche Materialien, die Sie im Rahmen seiner Werbung und seines Marketings zur Verfügung stellen, für einen Zeitraum von 5 Jahren zu Werbe- und Marketingzwecken zu verwenden, zu reproduzieren, zu modifizieren, anzupassen, zu veröffentlichen und anzuzeigen, soweit dies gesetzlich zulässig ist. Dabei wird der Sponsor Sie und/oder Ihren Beitrag benennen, soweit dies nach geltendem zwingendem Recht erforderlich ist.

 

Bewerbungen für das Programm sind nicht kostenpflichtig. 

 

3. Hinweise zur Teilnahme

Der Sponsor wählt bis zu 8 Projekte aus, die unter allen teilnahmeberechtigten Bewerbungen, die während des Programmzeitraums eingehen, unterstützt werden, wobei jedes Projekt mit dem angeforderten Betrag von bis zu 8.000 EUR („gesponserte Projekte“) unterstützt wird.

 

Alle teilnahmeberechtigten Bewerbungen werden vom Prüfungsausschuss, der aus Mitgliedern des Peak Performance Teams besteht, zum Abschluss des Programmzeitraums am 8. Mai 2023 geprüft. Die Prüfung wird bis zum 8. Juni 2023 abgeschlossen und die ausgewählten gesponserten Projekte werden den Bewerbern über die angegebenen Kontaktdaten bis zum selben Datum mitgeteilt. 

 

Sobald die gesponserten Projekte ausgewählt und den Bewerbern mitgeteilt wurden, wird zwischen dem Sponsor und den Bewerbern der gesponserten Projekte eine Sponsoringvereinbarung („Sponsoringvereinbarung“) abgeschlossen.

 

4. Der Sponsoringbetrag

Jedes ausgewählte gesponserte Projekt wird mit dem beantragten Sponsoringbetrag bis zu einem Wert von 8.000 EUR („Sponsoringbetrag“) gesponsert. Der Sponsoringbetrag kann je nach Projekt und Anforderung aus einer finanziellen Unterstützung sowie Produktunterstützung bestehen. Der Sponsoringbetrag wird den Bewerbern unverzüglich nach Unterzeichnung der Sponsoringvereinbarung zur Verfügung gestellt. 

 

Das Sponsoring ist persönlich, nicht umtauschbar, nicht übertragbar und nicht erstattungsfähig. Soweit dies nicht nach geltendem zwingendem Recht verboten ist, sind Sie allein für alle gegebenenfalls anfallenden Steuern im Zusammenhang mit Ihrem Erhalt und/oder der Verwendung des Sponsoringbetrags verantwortlich. Der Sponsor wird den Steuerbehörden Benachrichtigungen zukommen lassen und alle Steuern zahlen, zu deren Zahlung er gemäß geltendem zwingendem Recht verpflichtet ist. 

 

5. Haftung

Das Programm wird in keiner Weise von Instagram und Facebook gesponsert, befürwortet und/oder verwaltet und steht in keiner Verbindung zu diesen Plattformen. Sie erklären sich hiermit damit einverstanden, Instagram und Facebook aus jeglicher Haftung im Zusammenhang mit dem Programm zu entlassen und von dieser freizustellen und schadlos zu halten.

 

Soweit nach geltendem zwingendem Recht zulässig, erklären Sie sich durch die Bewerbung auf das damit einverstanden, den Sponsor und seine verbundenen Unternehmen von jeglicher Haftung freizustellen, die sich in irgendeiner Weise aus dem Programm ergibt, einschließlich, ohne Einschränkung, der Auswahl der gesponserten Projekte, der Verwaltung des Programms, und der Annahme oder Verwendung des Sponsoringbetrags oder eines Teils davon sowie damit, den Sponsor und seine verbundenen Unternehmen im Hinblick auf alle Ansprüchen, Schäden, Verbindlichkeiten, Verluste, Kosten oder Aufwendungen freizustellen und schadlos zu halten, die aus allen Ihren Handlungen oder Unterlassungen im Zusammenhang mit dem Programm entstehen oder auf diese zurückzuführen sind. Außer im Falle von grober Fahrlässigkeit oder vorsätzlichem Fehlverhalten ist die Haftung des Sponsors und/oder seiner verbundenen Unternehmen auf den Sponsoringbetrag beschränkt, soweit dies nach geltendem zwingendem Recht zulässig ist.

 

Das Programm zielt darauf ab, Projekte mit dem Ziel zu unterstützen, Frauen zu fördern, die aktiv am Outdoor-Lifestyle teilnehmen und die Geschlechterlücke in diesem Bereich schließen. Je nach gesponsertem Projekt kann die Durchführung des gesponserten Projekts bedeuten, dass Sie im Freien sind und an Sportarten und Aktivitäten teilnehmen, die ein inhärentes Risiko für Körperverletzungen oder sogar Todesfälle mit sich bringen können. Durch die Bewerbung auf dieses Programm erklärt sich der Bewerber in Bezug auf ein gesponsertes Projekt damit einverstanden, den Sponsor in Bezug auf jegliche Haftung in Bezug auf Schäden, Sachschäden, Körperverletzungen oder Todesfälle im Zusammenhang mit dem gesponserten Projekt zu entlassen, und erkennt an, dass die einzige Pflicht des Sponsors darin besteht, den vereinbarten Sponsoringbetrag bereitzustellen. Es liegt in der Verantwortung des Bewerbers, eine angemessene Versicherung für die Durchführung des gesponserten Projekts sicherzustellen. Nichts in diesem Abschnitt schließt die Haftung des Sponsors aus oder beschränkt sie, soweit diese gemäß dem geltenden zwingenden Recht nicht ausgeschlossen oder eingeschränkt werden kann. 

 

6. Streitbeilegung

Diese Bedingungen unterliegen schwedischem Recht.

 

Wenn Sie eine Beschwerde in Bezug auf diese Bedingungen haben, werden wir versuchen, die Beschwerde intern zu lösen. Letztendlich ist jede Streitigkeit vor dem erstinstanzlichen Gericht mit Zuständigkeit für den Ort, an dem Sie wohnhaft sind, anhängig zu machen.

 

7. Personenbezogene Daten

Alle personenbezogenen Daten, die im Zusammenhang mit dem Programm übermittelt werden, werden in Übereinstimmung mit der Datenschutzrichtlinie registriert und verarbeitet, die unter folgender Adresse verfügbar ist:
